§1 Validity towards entrepreneurs and definitions of terms
(1) The following General Terms and Conditions of Business apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).
§2 Conclusion of a contract, storage of the contract text
(1) The following regulations on the conclusion of contracts apply to orders placed via our internet shop https://www.saas-swiss.ch.

(3) The presentation of the goods in our internet shop does not represent a legally binding offer of contract on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our internet shop the following regulations apply: The consumer makes a binding offer to enter into a contract by successfully completing the ordering procedure provided in our Internet shop.
The order is placed in the following steps:
- Selection of the desired goods
- Confirm by clicking the buttons "Add to shopping cart
- Check the information in the shopping cart
- Press the button "Checkout".
- Login to the Internet shop after registration and entering the login details (e-mail address and password).
- Re-examination or correction of the respective data entered.
- Binding dispatch of the order by clicking the button "Buy now“
Before the binding sending of the order, the consumer can return to the website where the customer's details are recorded and input errors are corrected or the order process is cancelled by closing the Internet browser by pressing the "Back" button in the Internet browser used by him after checking his details. We will immediately confirm receipt of the order by an automatically generated e-mail ("order confirmation"). With this we accept your offer.
(5) Storage of the contract text for orders placed via our Internet shop: We send you the order data by e-mail. You can also view the AGB at any time at https://www.saas-swiss.ch/en/gtc. For security reasons, your order data is no longer accessible via the Internet.
§3 Prices, shipping costs, payment, due date
(1) The prices quoted include the statutory value added tax and other price components. Any shipping costs are added. Orders over CHF 150,- are free of shipping costs.
(2) The consumer has the option of payment in advance, invoice, PayPal, credit card (Visa / Mastercard / American Express) or SOFORT bank transfer (Klarna.).
(3) If the consumer has chosen payment in advance, he is obliged to pay the purchase price immediately after the conclusion of the contract.
(4) The invoice option is possible from an invoice amount of CHF/EUR 1.000,-, but a deposit of 50% of the total amount is required. The (total) sum is to be transferred to the following bank account:

§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. The delivery takes place here at the latest within 5 working days. In the case of payment in advance, the period for delivery begins on the day after the payment order is sent to the bank responsible for the transfer and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period shall end on the next working day.
(2) The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the buyer until the goods are handed over to the buyer, even in the case of mail order purchases.
§5 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
§6 Right of revocation of the customer as consumer:

Consumers are entitled to a right of revocation according to the following provision, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor his independent professional activity.
Right of withdrawal
You have the right to revoke this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You may use the attached model revocation form, which is not mandatory.
Consequences of withdrawal
If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (other than any additional charges arising from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event you will be charged for this refund.
We may refuse a refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.

§11 Voluntary return guarantee
(1) Irrespective of the customer's statutory rights, saås-Swiss Ltd. provides the customer with the following voluntary return guarantee:
The customer may also withdraw from the contract after the 14-day withdrawal period (see the withdrawal policy in § 6 of these GTC) by returning the goods within 30 days of receipt (period begins the day after receipt of the goods) to the following address:

Punctual dispatch is sufficient to meet the deadline. However, a prerequisite for exercising the rights under the voluntary return guarantee is that the customer returns the goods complete and undamaged (twist cap not opened) in the original sales packaging. Once the pipette bottles have been opened, a return is excluded.
(2) The voluntary return guarantee does not apply to the purchase of vouchers.
(3) The customer bears the return costs.
(4) When exercising the voluntary right of return, the refund is always made in the form originally used by the customer for payment.
(5) The legal right of revocation (see § 6 of these GTC) applies independently of the voluntary return guarantee in accordance with this § 11. Only the legal requirements mentioned in § 6 of these GTC apply to the exercise of the legal right of revocation. The legal right of revocation and the warranty rights of the customer according to § 8 of these GTC are not limited by the provisions for the voluntary return guarantee in this § 11.
§12 Returns
(1) If the customer exercises his right of withdrawal, saås Swiss AG requires that the goods be sent or delivered to saås Swiss AG with a detailed description of the reason for the withdrawal (withdrawal form) and with a copy of the payment confirmation or invoice with which the goods were delivered. Only unopened (screw cap intact) vials will be taken back.
(2) The shipping costs are to be paid by the purchaser.

§13 KiriTrees Plantage
saås Swiss AG acts as clearing agent for KiriTrees Plantage. The business relationship shall be exclusively between the tree purchaser and KiriTrees Plantage. For the purchase of the trees, the conditions listed in the separate contract shall apply conclusively. All information, disbursements and information will be made directly by KiriTrees Plantage.

GTC Kiritrees Plantage
Tree purchase agreement
KiriTrees Plantage hereinafter referred to as the Seller, is planting Paulowina trees „Elongata“ at various locations in Kosovo. With the purchase of these trees the buyer can achieve an interesting yield. At the same time, an active contribution is made to local and worldwide environmental protection. For this purpose the parties agree on the following contract, which combines the purchase, the care taking, cultivation and recycling of trees.
§1 Tree purchase
(1) the buyer buys the tree species Paulowina „Elongata“ in Kosovo.
(2) the purchase price for one tree is 165.– CHF resp. 150.– EUR* gross.
§2 Payment of purchase price
(1) the purchase price of 165.– CHF has to be paid within 14 days after conclusion of this contract to the following account of our clearing partner in Switzerland. (consumer protection)

(3) or with the payment providers available in the online store: PayPal or SOFORT / Klarna.
§3 Duration of the contract
(1) the contract begins with signing and ends with the utilization of the trees at the latest after 10 years, without the need for prior notice.
§4 Duties of the seller
(1) the seller shall prepare the area where the seedlings will be planted (hereinafter: reforestation area) for reforestation. This includes in particular the removal of any existing bush vegetation. The plowing, loosening the soil, and applying fertilizer, lime, and other nutrients. The seedlings are planted during the months of March to August. The reforestation period can take up to two months.
(2) during the contract period, the seller shall take care of the afforestation area in accordance with the recognized methods of forestry.
§5 No additional payment
(1) the purchase price includes all costs of planting, maintenance of the cultivated area, harvesting and sale of the trees purchased by the buyer. The purchaser is not obliged to make any further payments.
§6 Possession and transfer of ownership
(1) three years after the planting of the seedlings, the trees shall be marked according to quality characteristics for further use. In this way, the best price is obtained on the timber market. Knocking out the trees for biomass and industrial purposes is already possible and can give the buyer a first return. This takes place with consultation of the and only at the request of the buyer.
(2) Possible prices and profit margins are shown to the buyer.
(3) each tree will be given an individual identification number so that the buyer can identify his tree.
(4) KiriTrees Plantation is responsible for the processing and economic proceeds of the trees.
§7 Final harvest and proceeds
(1) in due time at the end of the contract, the seller shall harvest the trees standing on the afforestation area and shall sell the timber, taking into account the market demand.
(2) the seller is entitled to combine larger quantities as these can be sold more easily on the market. In this case, the payment is made according to the quota.
(3) after deduction of all taxes and duties in Kosovo, the proceeds are transferred to an account of the buyer.
(4) the buyer designates a bank account for this purpose.
§8 Liability
(1) the seller is liable only for intent and gross negligence. It is not liable for damages due to force majeure.
(2) the risks to the tree purchase are summarized in the brochure: Information for the investor.
(3) the trees are insured against fire, flood and wind breakage.
§9 Forest condition report
(1) the seller informs about the condition of the afforestation areas in regular intervals on the homepage and in any social media as well as by e-mail upon request.
§10 Resale
(1) resale of the trees to a third party is permitted with prior written consent of the seller.
§11 Final provisions
(1) place of performance and jurisdiction according to the national consumer protection law. This shall apply in the event that one of the parties to the contract has changed their domicile or habitual residence after the conclusion of the contract and this is not known at the time of filing an action.
(2) should any provision of this contract be or become invalid, this shall not affect the validity of the remaining provisions.
(3) the national consumer protection law with a two-week right of withdrawal after signing the contract shall apply. This has to be done in a short written notice. Mail or e-mail are sufficient for this.
